General Terms of use and Conditions of Sale

Purpose

The website www.nowopenart.net ( hereafter referred to as the “site”) allows art lovers and collectors to discover and acquire unique and limited edition artworks from artists of Galerie Jean-Louis Ramand ( hereafter referred to as the “gallery”). For more information, please see sections of “About us” and “Legal Notices“.

The purpose of these terms is to define conditions of online sales offered on our site and to define rights and obligations of the contracting parties. These are accessible and printable at any time on our site via a direct link at the bottom of the page.

The terms may be completed, if necessary, by specific conditions of use for certain Services, which complete the present general conditions.

Access to the site and services

Access to the content and services offered by our site is available to any person (minimum 18 years old) who has the legal capacity to commit to the present general conditions. Also accessible to any legal entity acting through a person who has the legal capacity to act and contract in the name and on behalf of the legal entity.

The gallery reserves the right, without prior notice or compensation, to temporarily or permanently close the website www.nowopenart.net or access to the online sales area. The gallery is not responsible for any damage of any kind that may result from these changes and/or temporary unavailability or permanent closure of all or part of the website or associated services such as the online sales area.

Agreement to the terms and conditions

Any order made through the site implies the prior consultation and acceptance of these general conditions. The full and unconditional acceptance of these general terms and conditions of sale is essential for the conclusion of the sales contract by the buyer. This acceptance is materialised by a box to be ticked on the Work order form.

Purchase of an artwork

A complete description is provided with the works featured on the Site, such as the characteristics, price, dimensions and kind of work. To purchase a work, the buyer must select the work of his choosing, place it in his basket and fill in the information required for the order. Before confirming the order, the buyer must check the information in the order summary. He/she will have the opportunity to correct any errors, as well as to check the delivery costs. If the purchaser encounters any difficulties during the ordering process, he/she can contact us by e-mail at contact@galeriejeanlouisramand.com or by using the contact form on the “contact us” page.

A confirmation email will be sent to the buyer within 24 hours of the order being placed. This email will validate the sale and confirm the availability of the work.

The price of a work and payment terms

The sale price of the Works is displayed on the Site and is indicated in euros, including all taxes, with the exclusion of delivery and packaging costs where applicable. Delivery costs may be applied and invoiced in addition to the price of the Works purchased. The amount of the applicable delivery charges will be indicated́ before the validation of the order by the purchaser.

The payment methods presented on the dedicated page “Secure payments” are an integral part of these general conditions.

The gallery reserves the right to suspend or cancel any order and/or delivery, in the case of non-payment of all amounts due by the buyer, in the case of a payment incident, or in the case of fraud or attempted fraud relating to the use of the Site.

Shipping

The delivery of the Works is carried out at the address indicated at the time of the buyer’s order, which may be different from the billing address. It will be delivered within the period indicated in the order confirmation email.

The delivery terms and conditions presented on the dedicated “Shipping & Delivery” page are an integral part of these general conditions.

Right of withdrawal

The Client has a period of 14 (fourteen) days from the date of receipt of the Work to withdraw from the contract without justification or penalty.

The return and refund procedures presented on the dedicated “Returns & Refund” page are an integral part of these general conditions.

The purchaser may exercise his/her right of withdrawal by sending an email to the following address contact@galeriejeanlouisramand.com before the 14 day period expires.

Applicable law and jurisdiction

The present general conditions of sale are managed by the French law.
Any legal proceedings relating to the validity, interpretation or execution of these General Conditions of Use and Sale must be instituted by the Tribunals of Aix en Provence.

Mediation

In the case of a litigation, the Buyer has the right to have access to a consumer mediator for the amicable resolution of any dispute relating to the execution of these general conditions, as provided for in articles L.611-1 et seq. and R.612-1 et seq. of the Consumer Code.

Changes of these terms of use and sale

The gallery reserves the right́ to modify the present general conditions at any time.
